Terms of Service

1. Account Terms

• You must be 18 years or older to use Ecomhint
• You must provide a valid email address and accurate information during registration
• You are responsible for maintaining the security of your account and password
• You are responsible for all activity that occurs under your account
• You may not use Ecomhint for any illegal or unauthorized purpose
• One person or legal entity may not maintain more than one free account

2. Acceptable Use

You agree not to:

• Use Ecomhint to analyze websites you don't own or have permission to analyze
• Abuse, harass, threaten, or intimidate other Ecomhint users
• Use automated means to access Ecomhint without our express written permission, other than the connections described in these terms
• Reverse engineer, decompile, or disassemble any aspect of Ecomhint
• Transmit any malicious code, viruses, or harmful data
• Attempt to gain unauthorized access to our systems or other users' accounts
• Use Ecomhint in a way that could damage, disable, or impair our service

3. Payment Terms

3.1 Plans and Purchases

• Ecomhint offers a free tier, paid subscription plans, and one-time report purchases
• Subscriptions are billed monthly in advance via our payment provider (Polar.sh). For subscriptions, you authorize us to charge your payment method on a recurring basis
• One-time report purchases unlock the full contents of a single audit report. They are charged once, do not renew, and do not include re-audits or future reports
• All prices are shown in USD and exclude tax. Applicable VAT or sales tax is calculated at checkout based on your billing country and collected by our payment provider (Polar.sh) as merchant of record

3.2 Price Changes

We reserve the right to change our pricing at any time. Price changes will not affect existing subscribers until their next renewal period. We will notify you at least 30 days before any price increase.

4. Cancellation and Refunds

4.1 Cancellation

• You may cancel your subscription at any time through your account settings
• Cancellation takes effect at the end of your current billing period
• You will retain access to paid features until the end of your billing period
• We reserve the right to suspend or terminate accounts for Terms of Service violations

4.2 Refund Policy

We offer a 14-day money-back guarantee on your first subscription payment and on one-time report purchases. If you are not satisfied with the service within 14 days of your purchase, contact us at [email protected] for a full refund, no questions asked.

For subscriptions, this guarantee applies to the first payment only. Subsequent renewal payments are not eligible for a refund under this guarantee.

After the 14-day period, refunds may be provided at our sole discretion in cases of:

• Service outages preventing access to paid features
• Duplicate charges or billing errors

Refunds are typically processed within 5-10 business days.

5. Audits and Automated Access

5.1 Audit Allowance

• A subscription includes 10 full audits per billing period
• The allowance is shared. Audits you start in the web app and audits started through a connected MCP client come out of the same 10
• An audit takes one slot when it starts. If it fails and produces no report, the slot is returned to you
• Unused audits do not carry over to the next billing period
• Cancellation takes effect at the end of your billing period, as described above. You keep the remaining allowance for that period

5.2 MCP Clients and Automated Use

You may connect your account to an MCP client and use it to read your reports, manage your tasks, and start audits. Setup steps are in our MCP documentation. The following applies to that use:

• Automated access is for your own account and the store configured on it. Do not share your connection or credentials with a third party
• Every audit must target a store you operate or are authorized to audit, whether you start it in the web app or through a connected client
• Do not use automated access to work around the audit allowance, for example with more than one account for the same store
• We may rate-limit, suspend, or revoke automated access that overloads the service, repeats failing calls, or breaks these terms. Where the problem is limited to one client, we may revoke that client rather than your account

6. Service Level and Availability

6.1 Service Availability

• We strive to provide a reliable service but do not guarantee 100% uptime
• We may perform scheduled maintenance with or without notice

6.2 Analysis Disclaimer

Important: Ecomhint provides analysis and recommendations for informational purposes only.

• No Performance Guarantee: We do not guarantee that implementing our recommendations will improve your conversion rate, sales, or any other business metrics
• Results May Vary: Every ecommerce store is unique. What works for one store may not work for another
• Analysis Accuracy: We do not guarantee the accuracy, completeness, or usefulness of any analysis results
• Your Responsibility: You are solely responsible for evaluating and implementing any recommendations
• No Professional Advice: Our analysis is not a substitute for professional business, legal, or technical consulting
• Test Before Implementing: We recommend A/B testing any significant changes to your store

Analysis results are provided "as is" for informational purposes. Any actions you take based on our recommendations are entirely at your own risk and discretion.

7. Intellectual Property

7.1 Our Rights

Ecomhint and its original content, features, and functionality are owned by Ecomhint and are protected by international copyright, trademark, and other intellectual property laws.

7.2 Your Content

• You retain ownership of any websites or content you submit for analysis
• By using Ecomhint, you grant us permission to analyze the submitted URLs
• We may store analysis results and use aggregated, anonymized data to improve our service

8. Limitation of Liability

To the maximum extent permitted by law:

• Ecomhint is provided "as is" without warranties of any kind
• We are not liable for any indirect, incidental, or consequential damages
• Our total liability shall not exceed the amount you paid us in the last 12 months
• We are not responsible for results from implementing our recommendations
• You use Ecomhint at your own risk

9. Indemnification

You agree to indemnify and hold Ecomhint harmless from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of Ecomhint
• Your violation of these Terms of Service
• Your violation of any rights of another party
• Your violation of any applicable laws or regulations

10. Privacy and Data Protection

Your use of Ecomhint is also governed by our Privacy Policy. By using Ecomhint, you consent to the collection and use of your information as described in our Privacy Policy.

11. Changes to Terms

We reserve the right to modify these Terms of Service at any time. We will notify users of material changes via:

• Email notification to registered users
• Prominent notice on our website
• Update to the "Last updated" date at the bottom of this page

Your continued use of Ecomhint after changes constitutes acceptance of the modified terms.

12. Termination

We reserve the right to terminate or suspend your account and access to Ecomhint:

• For violations of these Terms of Service
• For suspected fraudulent, abusive, or illegal activity
• At our sole discretion, with or without notice

Upon termination, your right to use Ecomhint immediately ceases. You may still be charged for any outstanding fees.

13. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the Czech Republic, without regard to its conflict of law provisions.

14. Dispute Resolution

Any disputes arising from these Terms of Service or your use of Ecomhint shall be resolved through:

• Good faith negotiation between the parties
• Mediation if negotiation fails
• Arbitration or courts of the Czech Republic if mediation is unsuccessful

15. Data Retention and Storage

15.1 Data Storage

• Analysis Reports: Stored for the duration of your active subscription
• Screenshots and HTML: Stored for up to 3 years or until account deletion
• Account Data: Retained as long as your account is active

15.2 Data Location

Your data is stored on secure servers:

• Database: Supabase (PostgreSQL)
• Analysis Screenshots: VPS server in Germany
• Blog Images: Supabase Storage

We use industry-standard encryption and security measures to protect your data.

15.3 Data Deletion

• You may request data deletion at any time by contacting [email protected]
• Upon account deletion, all personal data is permanently removed within 30 days
• Anonymized aggregate data may be retained for benchmarking and analytics purposes
